The Client shall not be entitled to decline to sign a timesheet on the basis that it is dissatisfied with the Services performed by the Temporary Worker.

5.8

Where it has been agreed that a Temporary Worker is to be placed on Fame Recruitment’s payroll, Fame Recruitment assumes responsibility for paying the Temporary Worker.

6.5

In the event that Fame Recruitment receives a written request from a Temporary Worker relating to the Client’s compliance with the AWR, Fame Recruitment shall promptly pass such request to the Client. The Client shall then compile a written statement containing the information necessary to comply with the AWR and return it to Fame Recruitment within 10 days of receipt of that request (or by such earlier date as Fame Recruitment may reasonably require).

7. Transfer & introduction fees

Where Fame Recruitment has introduced a Candidate to the Client for a Permanent Placement, and that introduction does not result in an immediate engagement through Fame Recruitment, but leads to an Engagement of the Candidate by the Client within 12 months from the date of introduction — the Client shall be liable to pay an introduction fee. That fee shall be calculated in accordance with the Fee Schedule as if the Candidate had been supplied through Fame Recruitment in the normal way, based on the Candidate’s gross annual salary or gross annual equivalent. No rebate of the introduction fee shall be payable if the Engagement subsequently terminates. VAT is payable in addition to any fee due.

7.2

7.5

In the event that a Candidate is introduced to the Client and is subsequently introduced by the Client to a third party — resulting in the Engagement of that Candidate by the third party within 12 months from the date of introduction — the Client shall be liable for an introduction fee calculated in accordance with clause

The Client shall also comply in all respects with all applicable statutes — including, without limitation, the Working Time Regulations, the Health and Safety at Work Act 1974, relevant by-laws, codes of practice, and legal requirements.

9.3

The Client shall indemnify and keep indemnified Fame Recruitment against any costs, claims, or liabilities incurred by Fame Recruitment arising out of any Temporary Placement, any breach of these Terms by the Client, or the Client’s failure to comply with the AWR — or where a Temporary Worker is unfairly dismissed or subjected to a detriment by reason of any act or omission of the Client.

11. Intellectual property

11.1

Fame Recruitment acknowledges that all intellectual property rights created during the performance of the Services by the Temporary Worker belong to the Client, and Fame Recruitment undertakes not to do any act inconsistent with such ownership.

For the purposes of this clause, “Confidential Information” includes trade secrets, financing, affairs, trade connections, client lists, and information regarding prices, discounts, business and financial marketing, or any other information of a confidential nature.
